James Gilliland

M, #1524, b. 17 July 1774, d. 22 September 1822
Last Edited=29 Jul 2018
James Gilliland was born on 17 July 1774 at North Carolina.1,2 He was the son of Robert Gilliland Sr. James Gilliland married Elizabeth Burks, daughter of Isham Burks and Elizabeth Rowland.1 (In the Revolutionary War Pension Files for Isham Burks was found two pages from their family Bible. It was from these pages that the birth and death dates of James and Elizabeth, as well as three of their children, were found.)3

On March 1, 1808 he purchased 167 acres of land in Overton County, Tennessee on the headwaters of Matthew's Creek from Aaron Rawlings for $152.4 James was listed as an Ensign in the 35th Regiment of the Tennessee Militia on September 15, 1808, for Overton County.5 On August 25, 1814, he was granted 50 acres of land on Matthew's Creek in the 3rd District. The land was originally granted to Isham Short (Warrant No. 2688 dated September 30, 1785 and entered on August 5, 1807) by the state of North Carolina for military services performed by Short. James became the assignee of the heirs of Mr. Short.6,7 On September 11, 1815 James was summoned as a juror by the sheriff in Overton County, Tennessee but was then released from further attendance as a juror at that term.8 On September 14, 1815, James purchased 280 acres of land on Matthew's Creek (formerly called Roaring River) from Samson Williams for $600.9 On March 17, 1817, James sold 48 acres of his land on Matthew's Creek to Adam Gardenhire for $200.10

James was found listed in the Resident's List for Cherokee County, Alabama Territory in 1819 as was his father-in-law, Isahm Burks.11 On March 15, 1820, in the circuit court minutes for Overton County, Tennessee, it was stated that James Gilliland and wife of Jackson County, Alabama were to give depositions for the plaintiff in the case of Alexander Mckinsey vs. James Peak. Jane Alley, of Overton County, was to give a depostion for the defendant.8 (Note: There are no census records that survived for Jackson County for the year 1820.)

In 1821, John Benge sold his reservation (located between the northeastern part of present day Stevenson and Edgefield) to James and William Dawson. When James' estate was settled in 1824, John Benge was paid a final payment of $775.00. It appears that James may have sold part of the reservation tract to Lemuel Gilliam and Meredith Price.12

James Gilliland died on 22 September 1822 at Jackson County, Alabama, at age 48.1,13 The Jackson County, Alabama Orphan's Court Probate Records (1820-1830) contain portions of James' estate proceedings. His estate was to have been recorded on pages 39-59 but, pages 21-44 are missing from the records. The first few pages are the estate sale. Among others, there were listed Allen Gilliland and Lemuel Gilliam. Starting on page 59 Lemuel Gilliam was recorded as Lemuel "Gilliland". From the records we are told that a Lemuel "Gilliland" was made the estate administrator and was legally appointed guardian of James' minor children William and Jefferson. The transcriber was in error. Lemuel "Gilliland" was really Lemuel "Gilliam" who was a doctor and postmaster at Doyal's Mill in 1830, and no relation to this family. (Attached is an excerpt from the Jackson County Chronicles January 2009 issue which shows the timeline for Lemuel Gilliam.)14,15 Allen Gilliland was appointed legal guardian of James' minor children Elizabeth and Carroll. I believe that Carroll was James Carroll Gilliland, and that Allen was his son Allen Gilliland. Listed in "claims against the estate" was William J. Price, guardian. William J. Price was an early settler of the Rocky Springs area of Jackson County. It is not known which child William Price was made guardian of but my guess it was Sallie as she later married William James Hughes who was William J. Price's nephew.

In the records are also found "cash received of sundry persons indebted to the estate of James Gilliland, deceased, on notes and accounts" - Isaham Burks Sr, $20.52. And under purchasers of the estate were the following:

William J. Price, various items
Allen Gilliland, various items
Isham Burks, Sr, Family Bible and various items.14
There is a deed in Rutherford County, TN between a James Gilliland and Burton L. Smith, both of Jackson County, AL, and John Barnes of Rutherford County. At one point I thought that this deed might pertain to this James. But, now I'm pretty sure that the deed is for the James Gilliland who was the son of John Gilliland and Sarah Berry. I just don't know for sure what "that" James Gilliland was doing in Jackson County, AL. But the deed was witnessed by James McFerrin & B. L. McFerrin and Burton L. Smith is supposed to have been married to Tabitha Duncan McFerrin.

James Carroll Gilliland was born on 15 April 1816 at Tennessee (1860 census records says Alabama.)1,2 He was the son of James Gilliland and Elizabeth Burks.3 James Carroll Gilliland married Rebecca Fine in 1836.4

Based on the research I've done, I believe that James Carroll Gilliland was the son of James Gilliland who died in Jackson County, Alabama circa 1823. I also believe that James Carroll's guardian, Allen Gilliland, was this Allen Gilliland who moved to Pope County, Arkansas and this is how James Carroll came to live in Arkansas.
